Terms & Conditions

The terms on which you may use the Rent A Roof website and mobile application and work with our team. Please read them carefully — by accessing or using the Portal you agree to them.

1. General terms

The website www.rentaroof.in and its mobile application (the “Portal”) are operated by Rent A Roof Private Limited (formerly known as Blue Reef Real Estate Private Limited) (“Rent A Roof”, “Company”, “we”, “us”, “our”). By accessing or using the Portal or our services in any manner — including simply browsing — you agree to be bound by these Terms & Conditions and our Privacy Policy, which together govern your use of the Portal. If you do not agree, please discontinue use immediately. We may modify these terms and our policies at any time; changes are effective when posted, and your continued use constitutes acceptance, so please review the terms on each visit. Nothing in these terms constitutes a partnership, joint venture or agency relationship between you and the Company. Our delay or failure to enforce any right is not a waiver of it, and we are not responsible for any breach caused by circumstances beyond our reasonable control.

2. Services offered

Rent A Roof is a real-estate brokerage that acts as a facilitator between you and property owners. Through the Portal we provide: (a) property search and matching assistance based on your inputs and our research, with the option to connect with our agents or desk for consultation and site visits; (b) support with viewings, negotiation of inventory and pricing, and assistance towards lease/agreement formation; and (c) for property owners, assignment of a Rent A Roof agent or affiliate who manages tenant enquiries, screening, viewings and transactional assistance. Our services are voluntary; if you do not provide the information required for a service, we may be unable to provide it. We are not a party to any tenancy, leave-and-licence or sale agreement between you and an owner, and we do not own the listed properties. We collect, hold and use the data you submit only for lawful and relevant purposes and take all practicable steps to keep it secure, as set out in our Privacy Policy.

3. Access to the Portal and registration

To access the Portal or create an account you must be at least 18 years old and competent to contract under the Indian Contract Act, 1872 and applicable law. You undertake that your registration details are correct, accurate, complete and current, and you will update them promptly if they change. You are solely responsible for choosing a secure password/verification method, for maintaining the confidentiality of your account, for preventing unauthorised access to your device, and for all activity under your account. You must notify us immediately of any suspected unauthorised use or security breach, and request account blocking if your device is lost or stolen. On creating an account you may opt to receive promotional communications from us, our affiliates or authorised partners, and you can manage your preferences or unsubscribe at any time.

4. User obligations

You agree to use the Portal lawfully and, in particular, that you will NOT: (a) transfer, sell, cut, copy, distribute, modify, recreate, reverse-engineer, decompile or disassemble any information, content or software from the Portal, or reproduce or circumvent its navigational structure, without our express written permission; (b) access the Portal through deep-links, robots, spiders, scrapers or other automated means, or probe, scan or test its vulnerabilities or security; (c) abuse, harass, threaten, defame or otherwise violate the legal rights of others, or impersonate any person or misrepresent your affiliation; (d) post or transmit information that is unlawful, harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of privacy, hateful, or racially or ethnically objectionable; (e) post content that infringes any intellectual-property or other right, or that encourages money laundering, gambling or any unlawful act; (f) upload or transmit viruses, malware or any harmful or corrupted code, or material you are not lawfully entitled to distribute; (g) collect or store other users’ data, conduct reverse look-ups, or trace other users; (h) delete or modify Portal content, or maintain multiple accounts without our written permission; or (i) use the Portal for any fraudulent, misleading or unlawful purpose, including impersonation, fraudulent cashback, money laundering, terrorist financing, or trading in prohibited or restricted items, or for any activity that threatens the unity, integrity, defence, security or sovereignty of India or its friendly relations with foreign states. You consent to automatic updates (bug fixes, patches, enhancements and new versions), and you understand that not all products, services and rewards are available in all locations. You remain responsible for all transactions under your account, whether authorised by you or negligently permitted.

5. Violation of user obligations

If we believe you have violated these terms, your obligations or our Privacy Policy, we may suspend your access to the Portal and/or delete your account without prior notice, and terminate our agreement with you and pursue any remedy available under law. Where we suspect suspicious or unusual activity or a fraudulent transaction, we may in addition (a) demand immediate refund of any amount we have paid to a payment gateway or bank on account of the transaction, (b) levy a penalty of 3% of the transaction amount (which we may increase depending on the severity of the violation), and (c) temporarily or permanently suspend your access to the Portal and services. You may contact our desk for restoration assistance.

6. Charges and payments

Browsing the Portal is free, but you must pay for the services you avail of. We reserve the right to amend this and to introduce charges for any or all services; where we do, you will be told before you access the service and may decline it without penalty. Changes take effect immediately upon notification unless stated otherwise.

7. Mode of payments

Where a payment is made through the Portal, we support: (a) UPI, using the identifier provided; (b) net banking or direct debit from your bank account; and (c) NEFT and RTGS, using the bank account, beneficiary and IFSC details provided. After making a payment you may be asked to upload a screenshot for validation, and our desk or the managing agent confirms the payment status based on it. We update the payment as confirmed after verification.

8. Security

We assure you that transactions on the Portal are secure and protected, and information you enter during a transaction is encrypted to guard against unintended disclosure. For UPI, net banking, NEFT and RTGS payments we neither receive, store nor retain your payment credentials — you share those directly with your bank or payment service, to which we have no access.

9. Disclaimer and liability

The Portal and its content are provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied, including as to quality, accuracy, reliability, adequacy, completeness, title, non-infringement or fitness for a particular purpose. We do not warrant that the Portal will be uninterrupted, timely, secure, or free of bugs, viruses or harmful components, and we may halt services for maintenance or other reasons without liability. Portal information is not a substitute for independent professional advice from a qualified lawyer, architect, surveyor or other specialist, and we are not liable for any loss arising from your reliance on it. Property descriptions and other information are provided in good faith by owners and other users, and we do not accept responsibility for their accuracy — you are responsible for verifying them. To the maximum extent permitted by law, we are not liable for any direct or indirect loss of business, revenue, profits or data arising from your use of the Portal or from dealings between you and an owner. Nothing in these terms limits any liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless the Company, its directors, affiliates, employees, agents and representatives from and against any claim, demand, loss, damage, cost or expense (including legal costs) arising out of your use of the Portal, the content you submit, your breach of these terms or any law, or any infringement of third-party rights.

11. Viruses, bugs and other attacks

We do not guarantee that the Portal or mobile application is or will remain secure or free of bugs or viruses, and you use it at your own risk; you should use your own virus-protection software. You must not knowingly introduce viruses, bugs, trojans or other technologically harmful material to the Portal. We are not liable for any loss or damage caused by such material distributed through the Portal, a linked website or a download, that may infect your device, software or data.

12. Intellectual property

The Portal contains intellectual property including proprietary software, text, scripts, sounds, photographs, music, videos, graphics, logos, trademarks and service marks, owned by or licensed to the Company; you acquire no right, title or interest in it. “Rent A Roof”, the Rent A Roof logo and our related brand marks are trademarks of Rent A Roof Private Limited (formerly known as Blue Reef Real Estate Private Limited). You may use the content only for your own personal, non-commercial use to the extent necessary to use the Portal, and you may not publish, perform, transmit, distribute, cache, print for distribution, sell, or use any automated means to collect, copy or re-publish the content. You may not post content protected by a third party’s copyright, trademark, trade secret or other right without their prior express permission, and you are solely liable for, and indemnify us against, any claim arising from material you post. By posting material you confirm you own it or have the owner’s permission, and you grant us an unrestricted, royalty-free, non-exclusive right to use, reproduce, publish, translate, transmit, display, distribute or otherwise use that material for any purpose, including commercial. We grant you a limited, non-exclusive, non-transferable licence to use the Portal only to the extent necessary to use it, and we may terminate this licence and prevent future access without prior notice. Claims of intellectual-property infringement may be reported to our Grievance Officer with supporting evidence.

13. Third parties

The Portal may contain links to third-party products, services and websites, and may display data provided by third parties, over which we have no control and for which we accept no responsibility. You should independently review their terms and policies before dealing with them, and you indemnify us against any claim or dispute arising from such dealings.

14. Temporary suspension

The Portal may be temporarily suspended for system maintenance, upgrades, or hardware or software failure, including for reasons beyond our reasonable control. We are not responsible for any inconvenience or damage arising from such suspension, and you assume the sole risk.

15. Force majeure

We are relieved of our obligations to the extent that their performance is prevented or delayed by circumstances beyond our reasonable control, including acts of God, governmental action, acts of terrorism, protests, riots, war or national emergency, fire, explosion, flood, epidemic (including any virus outbreak), lockdowns, embargo, strikes or other labour disputes, restraints or delays affecting carriers, inability or delay in obtaining suitable materials, or a hacker attack, intrusion or computer-virus attack.

16. Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Portal, and supersede all prior agreements or understandings, whether written or oral. If you do not agree with these terms or the Privacy Policy, you should discontinue use immediately.

17. Severability

If any provision of these terms is held to be unlawful, void or unenforceable by any court, tribunal or authority, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

18. Termination

We may terminate your licence and access without prior notice, and remove or discard any material or content, at our discretion. We reserve the right to change, modify, add to or delete any provision of these terms, with the updated terms serving as notice; please review them on each visit, as your continued use signifies acceptance. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — will continue to apply.

20. Governing laws and jurisdiction

These terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000. This agreement is executed between you and the Company at Delhi, India. In case of a dispute, the parties shall first attempt to resolve it amicably; if it is not resolved within 180 days of one party notifying the other of the dispute, it shall be subject to the laws of India and the jurisdiction of the courts at Delhi. Nothing herein prevents the Company from seeking remedies or initiating proceedings before judicial or quasi-judicial bodies in other jurisdictions. This is a computer-generated document and requires no physical or digital signature; visiting any page of the Portal or using our services constitutes your unequivocal acceptance of these Terms & Conditions and our Privacy Policy.
